Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Tapped smart tag management platform ("Service"), operated by Charis Studios ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. The Service

Tapped provides a web-based platform that allows users to create, manage, and analyze dynamic NFC tag and QR code experiences. The Service includes the dashboard at app.tappedtags.com, the tag resolution infrastructure at charis.ink, and any related APIs or tools.

2. Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account and keep it up to date.

You must be at least 13 years old to use the Service. By creating an account you represent that you meet this requirement.

3. Acceptable Use

You agree not to use the Service to:

• Distribute malware, phishing content, or other malicious material through your tags.
• Collect personal information from tag scanners without appropriate disclosure and consent.
• Violate any applicable law or regulation, including privacy and consumer protection laws.
• Infringe the intellectual property rights of any third party.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Resell or sublicense the Service without our written permission.

We reserve the right to suspend or terminate accounts that violate these standards, without prior notice.

4. Subscription Plans and Billing

Tapped offers free and paid subscription plans. Paid plans are billed on a monthly basis. You authorize us to charge your payment method on file at the start of each billing period. All fees are non-refundable except as required by applicable law or as expressly stated in our refund policy.

We may change our pricing at any time. We will give you at least 30 days' notice before any price increase takes effect on your account.

5. Your Content

You retain ownership of all content you create and configure within the Service, including tag actions, text, URLs, and any uploaded media. By using the Service, you grant us a limited license to store, process, and serve that content solely as necessary to operate the Service on your behalf.

You are solely responsible for ensuring that your content and your use of the Service comply with all applicable laws and do not violate the rights of any third party.

6. Intellectual Property

The Tapped platform, including its software, design, trademarks, and documentation, is owned by Charis Studios and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand features without our prior written consent.

7. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled or emergency maintenance that temporarily affects availability. We are not liable for any losses resulting from service interruptions.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or that any defects will be corrected.

9. Limitation of Liability

To the fullest extent permitted by law, Charis Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

You may close your account at any time. We may suspend or terminate your access to the Service at our discretion if you violate these Terms or for any other reason with reasonable notice, except in cases of serious violations where immediate termination is warranted.

Upon termination, your right to use the Service ceases immediately. We may delete your data after a reasonable period following termination.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice within the Service. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the changes.

12. Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Indiana.
